Refunds
 
         1.    Refunds are provided for the following reasons only:
            a. it is faulty or defective;
            b. it is not fit for the purpose for which it was purchased, or for which it is  commonly   
                used;
            c.it does not match any description or sample from which it was ordered.
         2.    No cash refunds will be available unless the original payment method was cash and 
                proof of cash payment can be provided.

Lay-by
 
1.       The seller is Living Red Pty Ltd ABN 31 117 916 033
2.       All goods will remain the property of Living Red until the lay-by is finalised.
3.       The initial payment must be no less than 20% of the total of the lay-by item(s).
4.       A non-refundable service fee (which includes GST) is payable on each lay-by item. This fee is 10% of the cost of each item in the lay-by sale.
5.       In the event the lay-by sale is cancelled, the service fee will become the cancellation charge. If the lay-by sale is not cancelled, then the service fee is counted towards the item price.
6.       The lay-by must be finalized within two months of the date the lay-by was entered into.
7.       Lay-by payments are to be made at least every 14 days throughout the term of the lay-by period.
8.       The lay-by form must be presented when making payments.
9.       No part of the lay-by goods can be separated and collected by the customer until final payment has been made in full.
10.   If the lay-by sale is cancelled, the refund of deposits and payments will be made in accordance with the applicable law.
11.   Any change of customer address must be notified to Living Red prior to the end of the lay-by period.
12.   These terms may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
 
 
Gift registry
 
  1. The gift list completed by you remains the property of Living Red Pty. Ltd.
  2. This service is only available if you have signed and returned these Terms & Conditions, and registered with Living Red Pty. Ltd. at 240 Hoddle Street, Abbotsford, VIC 3067.
  3. Completion of all details on the gift list is essential at the time of selection.
  4. Only products sold by Living Red Pty. Ltd. can be included on the gift list.
  5. The items listed on the gift list must not be marked down merchandise.
  6. Only you or one of you can delete unpurchased items from the list. Other people cannot do this on your behalf.
  7. A guest may add other items to the gift list as a guest choice.
  8. Living Red Pty. Ltd. will make copies of the gift list available to any person seeking to purchase from your list. This will contain your names, occasion date and gift suggestions.
  9. Full payment is required by guests for items they purchase. The item will then be taken off the gift list.
  10. You cannot lay-by goods for guests to complete the payments, however if you lay-by an item under your name, guests are able to contribute to the payments for that item.
  11. Not all items selected for the gift list may be available.
  12. The price listed on the gift list will be the full price of the item at the time of selection. The guest will be charged the price of the item as shown on the gift list.
  13. When a gift has been paid for, it becomes the property of the purchaser. If an item is to be delivered, delivery will be deemed to be on behalf of the purchaser.
  14. Living Red Pty. Ltd. can help the purchaser arrange delivery within the Melbourne metropolitan area. A fee will be charged for delivery payable by the purchaser at the time of purchase. Items will be delivered to an address nominated by the couple organizing the gift list within two weeks after the purchase has been made.
  15. Only those gifts purchased by guests, who request that their gift be delivered in accordance with this service will be delivered to your nominated address.
  16. Living Red Pty. Ltd. will endeavour to put the couple in contact with the delivery service to enable those two parties to arrange a mutually convenient time for the delivery. The delivery date must be prior to the occasion date.
  17. Deliveries outside of the Melbourne metropolitan area will incur additional charges and this amount must be paid prior to the delivery of the article.
  18. Living Red Pty. Ltd. cannot guarantee delivery at or by a particular time on the delivery date.
  19. You or your representative will be present at the nominated delivery address to accept gifts as they are delivered and sign an acknowledgement stating that you have received the gifts. Anyone at the delivery address who receives the delivery is presumed by Living Red Pty. Ltd. to be authorized to receive and sign the acknowledgement.
  20. You agree that Living Red Pty. Ltd. is not liable to you in any way in the event that gifts are delivered to you outside the delivery date due to any change in delivery instructions or circumstances caused by you (an additional delivery fee will need to be paid prior to re-delivery), or where circumstances (for example, a postal strike or industrial dispute) are beyond our reasonable control.
  21. Once goods are delivered, any items that require exchange or return will be exchanged with like merchandise or a credit voucher for the amount of the purchase price.
  22. Reasons for return of product are:
    1. it is faulty or defective;
    2. it is not fit for the purpose for which it was purchased, or for which it is commonly used;
    3. it does not match any description or sample from which it was ordered.
  23. No cash refunds will be available unless the original payment method was cash and proof of cash payment can be provided.
  24. These terms may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
 
 
Made to order terms
 
  1. When an order is placed, a non-refundable deposit of 50% of the total cost of the goods is required before the order will be submitted.
  2. The goods remain the property of Living Red Pty. Ltd. until they are paid for in full.
  3. The client accepts that Living Red Pty. Ltd. cannot give a definite date for when the articles will be available for collection.
  4. The client accepts that Living Red Pty. Ltd. can only give an estimation of the cost at the time the order is placed.
  5. The client accepts that if Living Red Pty. Ltd. deems it necessary to make minor modifications to the design and cannot contact the client then Living Red Pty. Ltd. is deemed to been given authority by the client to make such modifications.
  6. These terms may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
Gift Certificate

1. This gift certificate is only valid when endorsed with the signature of a Living Red staff member and their staff number.
2. This gift certificate can be used to purchase goods up to the value indicated on the gift voucher.
3. Where the cost of purchase exceeds the gift certificate value, the gift certificate holder will be required to pay the difference between the purchase price and the gift certificate value.
4. This gift certificate is not redeemable for cash.
5. This gift certificate is only valid for three months from the date of issue. It is the gift certificate’s responsibility to ensure it is redeemed before the expiry date.
6. This gift certificate is redeemable only once at Living Red and must be surrendered when used.
7. This gift certificate cannot be used for the purchase of discounted goods but can be used for goods that are advertised as on sale. Discounted goods are goods where the buyer has negotiated a discount with a Living Red staff member. On sale goods are goods that have a reduced price displayed on the selling ticket.
8. Gift certificates may not be redeemed for the purchase of gift certificates.
9. Gift certificates cannot be used for or charged to a pre-existing lay-by, or order, or to discharge indebtedness
10. When redeeming this gift certificate, you must use the entire balance of the gift certificate at once. You cannot carry the remainder of the gift certificate forward. Any balance not used will be forfeited.
11. You can only use one gift certificate per purchase.
12. Lost or stolen gift certificates will not be replaced under any circumstances.
13. Living Red reserves the right to refuse to accept an order and also reserves the right to immediately suspend the fulfilment of an order if the customer is in breach of any of these terms and conditions.
14. Terms and conditions may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
