Lay-by
1. The seller is Living Red Pty Ltd ABN 31 117 916 033
2. All goods will remain the property of Living Red until the lay-by is finalised.
3. The initial payment must be no less than 20% of the total of the lay-by item(s).
4. A non-refundable service fee (which includes GST) is payable on each lay-by item. This fee is 10% of the cost of each item in the lay-by sale.
5. In the event the lay-by sale is cancelled, the service fee will become the cancellation charge. If the lay-by sale is not cancelled, then the service fee is counted towards the item price.
6. The lay-by must be finalized within two months of the date the lay-by was entered into.
Goods that are not collected by the end of the two month period will incur a storage fee of $50.00 per week or part thereof. This must be paid along with the full cost of the goods before the goods will be released. Monies already paid as part of the lay-by will be used by Living Red Pty Ltd to cover the $50.00 weekly storage fee.
7. Lay-by payments are to be made at least every 14 days throughout the term of the lay-by period.
8. The lay-by form must be presented when making payments.
9. No part of the lay-by goods can be separated and collected by the customer until final payment has been made in full.
10. If the lay-by sale is cancelled, the refund of deposits and payments will be made in accordance with the applicable law.
11. Any change of customer address must be notified to Living Red prior to the end of the lay-by period.
12. These terms may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
Gift Certificate
1. This gift certificate is only valid when endorsed with the signature of a Living Red staff member and their staff number.
2. This gift certificate can be used to purchase goods up to the value indicated on the gift voucher.
3. Where the cost of purchase exceeds the gift certificate value, the gift certificate holder will be required to pay the difference between the purchase price and the gift certificate value.
4. This gift certificate is not redeemable for cash.
5. This gift certificate is only valid for three months from the date of issue. It is the gift certificate’s responsibility to ensure it is redeemed before the expiry date.
6. This gift certificate is redeemable only once at Living Red and must be surrendered when used.
7. This gift certificate cannot be used for the purchase of discounted goods but can be used for goods that are advertised as on sale. Discounted goods are goods where the buyer has negotiated a discount with a Living Red staff member. On sale goods are goods that have a reduced price displayed on the selling ticket.
8. Gift certificates may not be redeemed for the purchase of gift certificates.
9. Gift certificates cannot be used for or charged to a pre-existing lay-by, or order, or to discharge indebtedness
10. When redeeming this gift certificate, you must use the entire balance of the gift certificate at once. You cannot carry the remainder of the gift certificate forward. Any balance not used will be forfeited.
11. You can only use one gift certificate per purchase.
12. Lost or stolen gift certificates will not be replaced under any circumstances.
13. Living Red reserves the right to refuse to accept an order and also reserves the right to immediately suspend the fulfilment of an order if the customer is in breach of any of these terms and conditions.
14. Terms and conditions may be amended by Living Red Pty. Ltd. at any time and amendments will be posted on the Living Red web site and be deemed as the terms and conditions applicable to each contract.
